Rules for Zilla Grandhalaya Samsthas relating to contracts for supply of Materials, Goods and Services
[ G. 0. Ms. No, 317, Education (E).  25th February, 1969 — published at pages 174-177 R. S. to part I of A. P. Gazette dated 15-5-1969].
In exercise of the powers conferred by sub-section (1) of section 25 of the Andhra Pradesh Public Libraries Act, 1960 (Andhra Pradesh Act 8 of 1960) the Governor of Andhra Pradesh hereby makes the following rules for the making of contracts by the Zilla Grandhalaya Samsthas for supply of materials or goods or for rendering of services.


RULES

  1. Every contract for the supply of materials or goods or for rendering of services to the Zilla Grandhalaya Samstha shall be made by calling for tenders, provided that the Zilla Grandhalaya Samstha may provide in its bye-laws, the contracts, for supply of materials or goods or for rendering of services, other than those for the execution of works, the value whereof does not exceed rupees
  2. one thousand in respect of which tenders may be dispensed with. When tenders are invited they shall be tabulated and scrutinized by the Secretary, Zilla Grandhalaya Samstha and placed before the Zilla Grandhalaya Samstha with his recommendations for acceptance. The lowest tender shall ordinarily be accepted. Where it is considered undesirable to accept the lowest tender, the reasons thereof shall be recorded in writing and made available for the purposes of audit.

3. EXPLANATION: Where the lowest tender is in respect of more than one article, for example, stationery articles, the comparative prices rendered may be considered either individually for each   article or conjointly for all the articles or for specified groups of articles,   provided that the intention of the Zilla Grandhalaya Samstha to accept the lowest tender in any of these ways is made clear in the tender notice. If the tender is considered conjointly for all the articles or for groups of articles, the cost of all the   articles, or of all the articles in each group, as the case may be shall be worked out with reference to the rates given in each tender and the lowest tender will be that according to which total cost of the probable requirements of all the articles proposed to be taken together works out to be the lowest.
4.  Where the capacity to supply and the integrity of tender are not known or where they are doubtful, his tender need not necessarily be rejected but such additional security as the Zilla Grandhalaya Samstha or the executive committee, authorised by the Zilla Grandhalaya Samstha in this behalf considers necessary, shall be taken from the tenderer.
5. Where the lowest tender is rejected, the next higher tender shall be accepted, unless there are adequate reasons which should be recorded in writing for rejecting that tender also and the records thereto shall be made avail­able for purposes of audit and inspection.

  1. In no case shall a tender be accepted at rates other than, those specified in that tender. There shall be no avoidable delay in the disposal of   tenders after they are opened.
  2. CD Tenders shall be invited by the Secretary Zilla Grandhalaya Samstha in sealed covers in the most open and public manner possible, and invariably:- by a notice in the language or languages of the district posted at the office of the Zilla Grandhalaya Samstha and at such other places as the Secretary may deem fit;
  1. by advertisement in at least one newspaper circulating in the district where the value is expected to exceed Rs. 1,000.
     (2)   Every notice or advertisement published under sub-rule (i) shall state inter alia:-
    (a)   the conditions under which, the officer from whom, and the price, if any, for which, a copy of the Schedule of quantities of the various Kinds of articles can be obtained if they cannot be mentioned in detail in the notice or advertisement itself;
    (b)    the precise form in which the tender shall be mode, that is, whether the prices for the various articles are quoted and whether the comparative value of the tender will be examined with reference to each article mentioned in the Schedule of quantities or for all such articles conjointly or for groups of such articles;
  1. the time and place for presenting the tenders allowing a period of at least ten days from, the date of publication, of the notice at the office of the Zilla Grandhalaya Samstha or of the first advertisement in the newspaper as the case may be;
  2. the time and place for opening  the tenders;
  3. the amount of earnest money which should accompany the tender and the amount and the nature of the security which will be required in case the tender is accepted;
  4. the authority competent to accept the tender;
  5. that the authority competent to accept the tender reserves the right to reject any or all of the tenders received without assigning reasons;
    (h) that a tenderer who withdraws his tender, without valid reasons (to be decided by the authority competent to accept the tender) shall be liable to have his subsequent tenders summarily rejected.
    9.   Nothing contained in these rules shall apply to the purchase of ---
    (i) stores purchased through the Indian Stores Department or the Andhra Pradesh Stationery Department or through any agency authorised for Government Departments;
    (ii) articles from the metal and timber works and factories started by the Government for the re-settlement of ex-service men;
    (iii) controlled articles at controlled rates through a permit issued on the orders of Government or their agents;
    (iv) petrol from standing firms for its distribution and supply or from their authorised agents at the rates for the time being in force;
    (v) articles purchased from jails;
    (vi) articles obtained from manufacturing units stated by and to the Panchayat Samithi and Zilla Parishads in the State;
(vii)   books purchased direct from the authors or the publishers including cultural organisations;
(viii) library cards and other stationery articles peculiar to technical work of libraries;
  1. Notwithstanding anything in these rules, the Government may, for sufficient reason, permit the Zilla Grandhalaya Samstha to dispense with call­ing for tenders in any of particular case or class of cases or condone the non-observance of any of the provisions contained in these rules.
  2. Every accepted tender shall be entered into a contract and every such contract shall be made on behalf of the Zilla Grandhalaya Samstha by the Secretary of the Zilla Grandhalaya Samstha.
