Zilla Grandhalaya Samsthas Extension of Pensionary Benefits to the Employees of Zilla Grandhalaya Samsthas – Rules – Orders – Issued.

ORDER:
The following notification will be published in the Andhra Pradesh Gazette.
NOTIFICATION
In exercise of the powers conferred by clause (f) of Sub-section (2) of sec­tion 25 of Andhra Pradesh Public Libraries Act, 1960 {Andhra Pradesh Act No. VIII of 1960) the Governor of Andhra Pradesh hereby makes the following rules relating to the extension of pensionary benefits to the employees of the Zilla Grandhalaya Samsthas.
R U L E
Rules relating to the extension of Pensionary Benefits to the employees of Zilla Grandhalaya Samsthas:
1. These rules shall be called the Andhra Pradesh Zilla Grandhalaya Samsthas Pension-Cum-Gratuity Fund Rules, 1978.

2.   (1) These rules shall apply to all the employees of the Zilla Grandhalaya Samsthas borne on the regular establishment who retired or retire on or after 1st of July, 1975.
(3) The Andhra Pradesh Liberalised Pension Rules issued in G. O. Ms. No. 231, Finance, dated the 11th June, 1962 published in supple­ment to part-I of the Andhra Pradesh Gazette, dated the 19th July, 1962, as subsequently amended, from time to time, be made appli­cable mutatis mutandis to all the employees referred to in Sub-rule (1).

  1. In order to implement the Andhra Pradesh Liberalised Pension Rules
    hereby made applicable to the employees referred to in Sub-rule (1) above the Andhra Pradesh Zilla Grandhalaya Samsthas   Pension-cum Gratuity Fund be created in each Zilla Grandhalaya Samstha.   This will be part of the Zilla Gran­dhalaya Samstha Fund which is within the Public Account of the Government of Andhra Pradesh.

  2. The instructions appended in Schedule-I to these rules shall be followed to regulate the payment of pension and gratuity  under the rules  referred to in rule 2 above.

  3. The rules appended in Schedule-II to these rules shall be followed in operating the pension fund and disbursements of pensions and gratuities to the employees.

  4. These rules shall be deemed to have coma into force on the 1st July, 1975.

SCHEDULE-I
Instructions regulating payment of pensions:

  1. In regard to each pension the Secretary, Zilla Grandhalaya Samstha shall issue a pension payment order in Form-I in two halves of which one, known as Disburser's Half, is kept in the office of the Zilla Grandhalaya Samstha at which payment is to be made and the other is delivered to the pensioner.

  2. The disburser's half of each pension payment order shall contain the impressions of the thumb and each finger of the pensioner's left hand. These impressions shall be taken in the presence of the Executive Authority concerned when the Pension Application is prepared and   he/she shall sign the following certificate below them:

"Certified that the above finger prints have been taken in my presence and under my personal superintendence from the left hand of the person whose name is entered in the Pension Payment Order".

  1. A Pensioner shall produce his/her half of pension payment order before the disbursing authority whenever he/she claims payment of this pension and no payment shall be made if he/she fails to produce.

  2. When a portion of pension is commuted the disbursing  authority shall take back the pensioner's half of the pension payment order on  paying  him/her the amount due in the commutation as well as the amount of the unreduced pen­sion due up to the date on which commutation became absolute and shall return both halves of the Pension Payment Order to the Secretary, Zilla Grandhalaya Samstha concerned who will make suitable alterations in the pension payment order or issue a fresh one authorising payment of reduced pension in future. As a rule, apensioner shall take payment of his/her pension in person and the disbursing authority shall identify him/her with reference to the details available in the pension payment order before making any payment when claiming his/her pension for the first time, a pensioner shall also be   required to pro­duce a copy of the order communicating the sanction of his/her pension.

  3. Whenever a pensioner appears to take payment of his/her pension, the disbursing authority shall check his/her personnel marks with those recorded in
    the disburser's half of the pension payment order and compare her/his signature on the receipt with that pasted on the disburser's half of the pension payment
    order. If a pensioner cannot sign his/her name the disbursing authority shall compare his/her thumb impressions on the receipt with the original thumb impression previously taken on the disburser's half of the pension payment order.

  4. Pension payable at the office of the   Zilla Grandhalaya Samstha shall actually be disbursed at the Zilla Grandhalaya Samstha or at another Zilla Grandhalaya Samstha as desired by the Pensioner in writing and agreed to by the Zilla Grandhalaya Samstha concerned. In respect of pension payable at the Zilla Grandhalaya Samstha which
    sanctions the pension, the Zilla Grandhalaya Samstha paying the pension should have given its prior consent for payment of such pension to the Zilla Grandhalaya Samstha sanctioning such pension. In such cases the Secretary of Zilla Grandhalaya Samstha which has agreed to pay the pension shall actually dis­burse the pension from the pension funds of the Zilla Grandhalaya Samstha and recover the amount from the pension fund of the Zilla Grandhalaya Samstha which sanction the pension by sending acquittance of each pensioner and the voucher duly paid which shall be filled in the Zilla Grandhalaya Samstha office which sanctioned the pension.

  5. In respect of the pension payable in the office of the Zilla Grandhalaya Samstha at the request of the pensioner the Secretary of the Zilla Grandhalaya
    Samstha and recover the amount from the pension funds of the Zilla Grandhalaya

Samstha concerned each month by sending acquittance of each pensioner and voucher duly stamped and paid which shall be filed in the Zilla Grandhalaya Samstha office which sanctioned the pension.
10.    (a) The Secretary Zilla Grandhalaya Samstha shall prepare the pension papers in the prescribed proforma and forward the same to the Audit Officer for fixing pension and retirement gratuity admissible. The Audit Officer shall scrutinize the pension papers and certify as to the correctness of the calculations of service of pensioners and return the pension papers to the Secretary, Zilla Grandhalaya Samstha to obtain the sanction of pension and to effect the payment.
(b) If a pensioner desires to have the payment of his pension at the Headquarters of a Zilla Grandhalaya Samstha of the same district or some other district within the state, the Secretary, Zilla Grandhalaya Samstha from which the pensioner retired, shall issue the pension payment order for payment in aforesaid places after obtaining the prior consent of the Secretary, Zilla Grandhalaya Samstha concerned shall pay the pension initially from the amounts available in the pension fund and recover amount of pension paid during the succe­eding month as indicated in the instructions above. This instruction will apply in respect of any subsequent changes in the place of payment of the pensions.
11.  Amounts required for payment of pensions shall be drawn as an imprest from the pension fund.   The total amount of pension paid out of such imprest should then be debited to the pension fund   by contra-credit to such fund. The unused portion of the imprest remitted back to the fund should be accoun­ted for under suspense account—payments adjusted (Pensions).

  1. The imprest drawn should be limited to a week’s requirements and should be drawn on the first working day of the week and the unspent balance if any, should be remitted back on the last working day of the week.   The same procedure should be followed for the payment of pensions to be made in the second and succeeding weeks of the month.   The unspent balance of the imprest should in no case be kept in the Zilla Grandhalaya Samstha office beyond the last working day of the month.

  2. The vouchers relating to pensions paid out of imprest should be stam­ped 'Paid In Cash’.

  1. Any deviation from the above procedure should be specifically authorised by the Director of Local Fund Audit. No pension of the Zilla Grandhalaya Samstha employees shall be disbursed at a bank.

  2. In order to facilitate the identification of pensioner, a duly authenticated copy of a passport size photograph of every pensioner shall be affixed to the disburser’s half of the pension payment order and the photograph so affixed should be renewed whenever the disbursing authority considers it necessary.

A pensioner   shall   be required to pay for   the photographs required for   this purpose.
17.    Pensioners who produce satisfactory evidence that they are  unable to appear because of bodily illness or infirmity need not appeal at the office of the pension payment to claim payment of pensions.
18.    Pension due to any pensioner belonging to one of the classes mentioned in instruction 17 may be disbursed to a messenger who presents the Pen­sioner's half of the pension payment order along with:

  1. a proper bill signed and received by the pensioner and  bearing an  endorsement also duly signed by him authorising payment to such messenger, and

  2. a life certificate in respect of pensioner signed by the Secretary,  Zilla Grandhalaya Samstha, or by a Government servant  drawing a pay of Rupees
    three hundred per month or more or if there is  no such  person as mentioned above at the place where the pensioner resides some other well-known trustworthy person. The disbursing authority may accept for this purpose a life certificate signed by a Sub-post Master, a Village headman if he considers them to be trustworthy.

19.    (a)    A pensioner of any description need not appear at the office of payment of pensions in person to claim payment of his/her   pension if he/she produces a life certificate signed by some person exercising the powers of a Magistrate under the Criminal Procedure Code (Act No. 2 of 1974) or by any Registrar or Sub-Registrar appointed under the Indian Registration Act, 1908 (Act No. XVI of 1908) or by any pensioned  officer who  before  retirement exercised the powers of  Magistrate or  by   any Gazetted Officer or by a Munsif or by a Police Officer not below the tank of Sub-Inspector in charge of Police Station or the President of a Panchayat Samithi or a President of Panchayat.
(b) The pension due to any pensioner may be disbursed to a messenger who presents the Pensioner's order along with (1) a proper bill signed and receipted by the pensioner and bearing an endorsement also duly signed by him/ her authorising payment to such messenger and (2) a like certificate in respect of the pensioner signed by a person holding one of the qualifications mentioned in instruction (a) above,
20.    A disbursing authority shall not pay a pension for any month to a messenger under instruction 17 or 18 or 19 if the date of the life certificate is earlier than the last day of that month. He shall also invariably take the signature of the messenger in whose favour the pensioner has endorsed the bill in token of the receipt of the amount specified in it. When the messenger is illiterate, his thumb impression shall be taken duly attested by a witness.  The disbursing authority is personally responsible for any payment wrongly made. Whenever he feels a doubt as to the proper course of action he should consult the Director of Public Libraries.

  1. A leper pensioner shall ordinarily appear before the disbursing authority to claim his pension without preparing a bill.   The disbursing authority shall then direct one of his clerks or Assistants to fill up a pension bill form on behalf of the pensioner.   Payment shall be made at once to the pensioner on this bill and the disbursing authority shall mark the bill by means of a  stamp as  having been paid in presence and record the fact of payment, in both halves of the pen­sion payment order under his initials.   Both halves of the pension payment order shall be retained in the office of payment in these cases.

  2. When a leper pensioner is unable to appear before the disbursing authority due to bodily infirmity, he shall send a life certificate under   subsidiary instruction (b) of instruction 18 but not a bill. The disbursing  authority shall
    have the bill prepared and either remit the pension   irrespective of any money limit and Postal Money Order or if the  pensioner  has requested   him to do so,
    arrange for it to be paid through the Executive authority of the  Gram Panchayat in which the pensioner lives before two responsible witnesses. The procedure to
    be followed when a pension is paid to a leper pensioner through the Executive authority of a Gram Panchayat is prescribed in Annexure-I.

23. (a) The disbursing authority shall take adequate precautions to prevent the payment of any fraudulent claims on account of the pension of a pensioner who does not appear in person to take payment. When a pensioner draws his pension in accordance with the provisions of instructions 17, 18, 19 and 20 the disbursing authority shall require proof of his continued existence, independent of that furnished by the life certificates, to be furnished at least once a year. For this  purpose he shall require each such pensioner to attend personally at the office of payment for due identification at least once a year, unless he is exempted from personal appearance under instruction 17 in which case the necessary independent proof of the pensioner's existence shall be obtained by some suitable method. When a pensioner alleges that he/she is unable to appear personally at the office of payment on account of bodily illness or infirmity the disbursing authority shall require adequate proof of such inability to be furnished once a year in addition to the independent proof of the pensioner's existence.
(b) The Secretary, Zilla Grandhalaya Samstha, shall see that the disbursing authority furnishes certificates showing that they have obtained at least once in a year the necessary, independent proof of the continued existence, etc., of pensioners exempted from personal appearance whose pensions are paid at places other than the headquarters of the Zilla Grandhalaya Samstha.
(c) A pensioner of rank may be identified privately by the disbursing authority and need not be required to appear at a Public Office.
(d) The disbursing authority shall take special care in regard to the payment of the pension of any woman not accustomed to appear in public since such payments involve a special risk of fraud.  No payment shall be made except

on a life certificate as prescribed in instruction 19 which shall be attested on each occasion, as an additional precaution, by two or more respectable per­sons of the pensioners town or village. The disbursing authority shall also arrange to have every such pensioner examined at least once a year by two non-purdah female pensioners who shall check her personal marks with those recor­ded on the disburser's half of the pension payment order, and shall compare her signature, if she is illiterate her thumb impression on the receipt with that already taken on the disburser's half of the pension payment order. These exa­minations shall be conducted as far as possible without any extra expenditure by the Zilla Grandhalaya Samstha. Extra expenditure may be incurred in special cases when it is unavoidable.
(e) Whenever any person is allowed to draw pension without appearing in person at the office of payment the fact shall be noted on the pension payment order and the disbursing authority shall initial the note. He shall then see that a further note is made on it every year as to the manner in which independent proof is obtained within that year of the pensioner's continued existence (e.g. pensio­ner visited the office of the Zilla Grandhalaya Samstha etc.) and initial it after verifying that the proof has actually been obtained in that form and is sufficient.
24.    (a) The pensioners receipt for each payment shall be taken on a sepa­rate bill in the Form shown in instruction 26 (b) as the case may be, and atta­ched to a schedule of payments of pension of each kind, or if pension payments are few in number, to the list of payments.
(b) Every payment of a pension shall be entered on the reverse of both halves of the pension payment order and attested by the initials of the disburs­ing authority.
25.    The disbursing authority shall not make any payment of pension to any pensioner other than who retired as a last grade employee until he has signed
on each occasion when he claims payment a certificate of non-employment if a pensioner who is required to sign the certificate has been re-employed either
permanently or temporarily under a Government or a local body in India during the period for which he claims pension he shall furnish the necessary particulars in the certificate and the disbursing authority shall ascertain and report to the Director of Local Fund Audit whether the rules regarding such re-employment have been duly observed.   If a pensioner who is required to sign certifi­cates is illiterate the disbursing authority shall see that the meaning of the cer­tificate is explained to him verbally on each occasion on which he claims pay­ment of this pension.
Explanation:   This instruction shall not apply to payment of pension by Postal Money Order.
26. (a) When a pension is granted on condition that it shall be paid only so long as a specified event other than the pensioner's death has not taken place, no payment shall be made unless the pensioner furnishes a certificate on each occasion that, that event has not taken place.

 (b) As an exception to instruction (a) above, a woman whose pension is payable only so long as she does not marry or remarry shall not be required to certify that she has not been married on each occasion when payment is made, but shall be required to attach a declaration in the following form at the end of each half-year to the bill for her pension for the month of December or June, as the case may be.
"I hereby declare that I am not married and have not been married during the six months ending 30th June, 19         31st December, 19  .................. Daughter/Widow of the Late........................................... We certify to the best of our knowledge and belief that the above declara­tion is correct. (To be signed by two responsible Government servants or well known trust-worthy persons).
27.   The pension of an insane person may be paid to a guardian appointed under the Indian Lunacy Act, 1912 (Central Act IV of 1912) or to any person authorised by authority which sanctioned the pension to receive it. Such guar­dian or person shall be required to furnish with each claim a life certificate as prescribed in instruction 16 stating that the pensioner was alive on the last day of the period for which the pension is claimed.
Payment of Pensions by Postal Money Order:
28.   "if a pensioner whose pension does not exceed Rs. 100 (Rupees hun­dred only) a month, presents his copy of his pension payment order in person
to the disbursing authority together with a declaration that he wishes his pension to be paid by postal money orders at his cost in future the pension shall thereafter be paid in that manner at the cost of the pensioner so long as the declaration is in force and the pension remains payable. The disbursing authority shall observe the following instructions in regard to the payment of pensions by money order:
(1) When a pensioner makes an application in person in the manner prescribed above, the disbursing authority shall identify him in the manner prescri­bed in instruction 5 and instruct him to communicate promptly any change in his address. The necessary entries regarding the pensioners declaration shall then be made in a 'Register of pensions payable by money order' specially ope­ned for the purpose, and the declaration and both halves of the pension pay­ment order shall be filed with the register.

  1. Not later than the 10th of each month the clerk to whom the disbursing authority allots the duty shall make out a money order form for each pensioner noted in the register mentioned above for the amount of pension payable less the money order commission, and make corresponding payment entry on the back of both halves of the pension payment order.   The  disbursing  authority shall sign each money order form and  initial the corresponding  entries on the back of both halves of the pension payment order comparing the three documents carefully and satisfying himself that the entries are correct.

  2. The disbursing authority shall make the necessary payment to the Post Office on account of these money orders not in cash but by transfer to the credit of the post office in the Treasury Accounts.  He shall send the money order form to the Post Office with  a covering list and a certificate that he has credited the Amounts of the money orders and the commission payable on them to the ''Post Office" by transfer  in the treasury accounts.   A separate receipt shall be obtained from the Post Office for each money order and filed in the treasury.

  1. Separate pension bills need not be prepared for each pensioner.   The payment shall be shown in a separate schedule in the Form shown in the Annexure II.   The total amount of the payments shown in the Schedule shall be written both in figures and in words.  The disbursing authority shall satisfy himself that all the amounts shown as paid in the schedule have actually been remitted by money order and certify accordingly on it.   The disbursing authority shall write his pay order on the schedule; it shall then be stamped ‘Paid by transfer’ and forwarded to the Secretary, Zilla Grandhalaya Samstha with the correspon­ding list of payments as a voucher supporting the debit to the pension Fund.

  2. The disbursing authority shall see that the payees money order receipts are duly received for all the remittances shown in the register.   He shall compare the signature (or thumb impression) on each such receipt every month with the pensioner's signature (or thumb impression) an the pension payment order and satisfy himself that it is genuine. The receipts shall then be filed in the Office of payment in the next month's schedule of pension payments the dis­bursing authority shall certify as follows:

"I certify that I have satisfied myself that all pension payments shown in the schedule for the previous month have been paid to the proper persons and that I have obtained the payees’ money order receipts in support of all these payments and filed them in my office".
(6)  The disbursing authority shall satisfy himself once every six months in such manner as he thinks desirable, that the pensioner is actually alive. In token of having done so, he shall endorse on the schedules of payments for the mon­ths of April and October each year a certificate to the effect that he has satisfied himself that the pensioners were actually alive on the dates on which the pensions were remitted to them.

(7) The disbursing authority shall obtain from each woman whose pension would terminate on her marriage or re-marriage and whose pension is permitted by money order, a half-yearly declaration in the form prescribed in instruction 26 (b) for the half-year ending on the 30th June or 31st December. He shall also obtain from every pensioner whose pension is remitted by money order, other than one who retired as a last grade employee a half-yearly declaration for the half-year ending on the ending on the 30th June or the 31st December that he has not received any remuneration for serving under the Government or Local Body in any capacity during the half-year. He shall certify as follows on the schedules for January and July.
"I certify (1) that I have obtained from each pensioner other than one who retired as a last grade servant a declaration that he has not received any remuneration for serving under the Government or a Local Body in any capacity dur­ing the past six months, and (2) that I have obtained from each woman whose pension would terminate on her marriage or re-marriage a declaration in the form prescribed in instruction 26 (b) that she is not married and has not been married during the past six months".

  1. The certificates mentioned in clauses (3), (5), (6) and (7) shall be given by the disbursing authority for payments made at the office of payments.

  2. Where owing to old age or infirmity or in consequence of some physical disability, it is not possible for a pensioner to present in person to the office of payment a declaration electing to have his pension paid by money order, the disbursing authority may accept instead a written declaration signed by the pen­sioner which is duly verified by a Gazetted Officer, a magistrate or a Justice of peace or President of a Panchayat Samithi o Panchayat. The Officer or autho­rity, verifying the declaration shall specify the circumstances in which he holds that it is not possible for the pensioner to present the declaration in person to the disbursing authority.

(10) Should the pensioner be physically incapable of signing the declara­tion, the disbursing officer may authorise payment to the pensioner on produc­tion of a certificate from Assistant Civil Surgeon of the district or a Registered Medical Practitioner to the effect that the pensioner is alive but is unable to sign the required declaration in such a case, the pension may be paid to the heir, not being a minor, who would receive payment of the arrears of pension in the event of the pensioners death, provided it is certified by the District Collec­tor that the person claiming to be the heir is in fact, the heir and continues to be the heir throughout the period for which he draws the pension.


Periodical appearance of pensioners for identification :
On the first appearance of a pensioner and once in the course of every year thereafter, the disbursing authority shall take an impression of the thumb and all the fingers of the pensioner’s left hand on the pension bill.

a)   He shall then identify the pensioner with  reference to the particulars given in the disburser's half of the pension payment order if he cannot identify the pensioner by other means with absolute certainty, he shall identify him by a comparison of the thumb and finger impressions taken on the bll with those posted on the pension order.
Exception :- This instruction does not apply to a pensioner who is a holder of a Government title nor to one whose pension exceeds Rs. 50 (Rupees fifty only) a month nor to one whom the Government have specially exempted from this requirement, not to literate pensioners who can sign their pension bills, provided that in cases of doubt where the pensioner cannot be identified by other means it shall still be open to the disbursing authority to take thumb and finger impressions on the pension bill.
(b)  A woman who is exempt from personal appearance under instruction 17 because she is not accustomed to appear in public should affix an impression of her left thumb on each bill in the presence of the person who signs the life certificate and the latter should attest it. An illiterate pensioner should similarly affix an impression of his left thumb on each bill in the presence of the person who signs the life certificate or, when he attends at the paying office in person to receive payment before the disbursing authority and the person who signs the life certificate or the disbursing authority as the case may be should attest it.   In the case of an illiterate pensioner or a woman who is   not accustomed to appear in public acquaintance  by a seal mark attested by some known and respectable person may be accepted in lieu of thumb impression.
(c)  When a pension payment order is renewed the original thumb and finger impression shall be cut off from the old order and attached to the new order.


30. (a) In order to ensure that each pensioner attends personally at the paying office at least once a year unless he fails within the terms of the exception to instruction 20 (a) above or is paid by money orders the disbursing authority shall write the letters 'L.C.’ with his initials in the case which the monthly payment is noted on the reverse of the disbursers half of the pension payment order whenever the payment made on a life certificate and shall send through the mes­senger who receives payment of the pension in the month previous to that in which the pensioner is due to appear in person a call Form prescribed in Annexure-III for the personal appearance of the pensioner for the Annual muster in the following month, or require proof, independent of that furnished by the life certificates of the continued existence of the pensioners, when the period of continuous non-appearance approaches a year. In the case of re-employed pensioners when personal appearance is inconvenient it will be sufficient if a certificate from the head of the office or department in which they are reemployed to the effect that the pensioner is re-employed and continues to be re-employed in his office or department is produced before the pension disbursing authorities.

(b)   When a pensioner draws his pension through an agent who has execu­ted a bond to refund overpayments, the person shall not be paid on account of a period of more than ayear the date of his life certificate last received. The Dir­ector of Local Fund Audit and the disbursing authority shall watch carefully for authentic information of the death of any such pensioner and see that no further payment is made after such information is received

of service payments:
31.    The following procedure shall be observed in  regard to the transfer of payment of a pension from one district to another in the State:
The Secretary, Zilla Grandhalaya Samstha of the district from which the pensioner retired shall forward both halves of the pension payment order to the Secretary, Zilla Grandhalaya Samstha of the new district of transfer with infor­mation as to the date up to which payment was made in the old district and shall simultaneously forward a copy of the communication to the Director of Local Fund Audit. On receipt of the intimation of transfer from the Secretary, Zilla Grandhalaya Samstha, the Director of Local Fund Audit will assign a new num­ber to the pension payment order and intimate it to the Secretary, Zilla Grandhalaya Samstha of the new district of transfer who shall note it in both halves of the pension payment order.
If at the time of transfer, the pension payment order is renewed on account of the pensioner's half having been lost, the Secretary, Grandhalaya Samstha of the new district of transfer shall be informed of the loss and renewal.
Renewal of Pension Payment Order:
32.    (a)  The Secretary, Zilla Grandhalaya Samstha concerned is authorised to renew a pension payment order without reference to the Director of Local Fund Audit when the  entries on the reverse  of   either the pensioner's or the disburser' half is completely filled up or the   pensioner's half is lost v orn or torn. When the renewal is due to the loss of the original pension pay­ment order, a fee of one rupee shall be collected from the pensioner for the dup­licate. Every renewal pension payment order shall bear the old number and date and the specimen signature or finger prints of the pensioner and the copy of the photograph where it is kept shall be cut out from the disburser's half of the old pension payment order and pasted on the  disburser's half of the new pension payment order. The Secretary, Zilla Grandhalaya Samstha shall retain the old pension payment orders for three years and then destroy them. A note of the issue of every new pension payment order shall also be made in the remarks column of the register of pension payment orders.
(b) When the Secretary, Zilla Grandhalaya Samstha, has Issued a new pen­sion order in place of lost one, he shall by strict observance-of instruction 24(b) see that no payment is made on the pension payment order alleged to have been lost.
33. If pension remains un-drawn for more than one year the pension shall cease to be paid. If however the pensioner afterwards appears, the disbursing authority may renew payments. The disbursing authority shall not, however, pay the arrears if the pension in arrears is to be paid for the first time or if the amount of arrears exceeds Rs. 1000 (Rupees one thousand only) without obtaining the previous sanction of the Director of Local Fund Audit and the Secretary, Zilla Grandhalaya Samstha. A pension not drawn for three years shall cease to be payable unless it is revived by an order of the Government.

  1. The arrears of pension due on account of a deceased pensioner shall cease to be payable if they are not claimed within one year of the pensioner's death.

  2. The disbursing authority shall examine the files of pension payment orders carefully every month and remove all the pension payment order relating to cases of the kinds mentioned in instruction 34. He shall return the disburser's halves of the pension payment orders concerned to the Director of Local Fund Audit with a half-yearly statement of such cases.   The reason for the non-drawal, if known shall be stated against each name.

36.    When a pensioner has failed to appear to receive his pension for three months, the disbursing authority should make enquiries through the District Police as to the cause of his non-appearance.
Deceased Pensioners:

  1. A pension shall be payable for the day of a pensioner's death,  irrespe­ctive of the hour at which death takes place.

  2. (a) After the death of a pensioner, the disbursing authority may pay any arrears actually due to the pensioner’s heir or heirs, provided they apply within one year of the date of death. If the application is made later, the arrears shall not be paid without obtaining through the Director of Local Fund Audit the previous sanction of the authority which sanctioned the pension. If however the arrears of pension does not exceed Rs. 100 (Rupees one hundred only) and the case presents no peculiar features, the Director of Local Fund Audit may direct that the arrears be paid on his own authority.

(h) After paying the arrears of pension due on account of a deceased pensioner, the disbursing authority shall return both halves of the pension payment order to the Director of Local Fund Audit with a note of the Date of the pensioner's death.
39.  (a) A person who claims payment of arrears of pension, as heir of deceased pensioner shall be required to produce the pensioner's half of the pension payment order, or, if no pension payment order has been issued, the copy of the order which sanction to the  pensioner was communicated to the pensioner or his heir.  He shall also be required to produce a death certificate regarding the death of the pensioner and sufficient evidence to establish his relationship to the deceased.

  1. When the amount of arrears due to a deceased pensioner does not exceed Rs. 500 (Rupees five hundred only) payment may be made to the heirs of the deceased after following the procedure laid down under instruction 38 and under the order of the Secretary, Zilla Grandhalaya Samstha or other office responsible for the payment after such enquiry as he considers sufficient regarding the claimants right and title.  In that case the disbursing authority need not insist on the production of letters of administration or similar legal authority. The records of enquiry by the Secretary, Zilla Grandhalaya Samsthas or other officer responsible for the payment should contain the signed state­ments of at least two trusts worthy of disinterested persons.

  2. When amount of arrears due to a deceased pensioner exceeds               Rs. 500 (Rupees five hundred only) payment to the extent of Rs. 500 (Rupees five hund­red only) may be made by the disbursing officer as set forth in instruction 39 (b) above.   The excess over Rs. 500 (Rupees five hundred only) but not exceeding Rs 2,500 (Rupees two thousand five hundred only) should  be paid only under the order of the Director of Public Libraries and excess over Rs.2,500 (Rupees two thousand five hundred only) by Government on the execution of an indem­nity bond in Form 6 in the Andhra Pradesh Financial Code with sureties of pro­ved financial ability to meet the obligations under-taken, provided that the Zilla Grandhalaya  Samstha is   satisfied as to the claimants right and title and consider that under delay and hardship would be caused by insisting on the production of letters of administration.

  3. Whenever there is any doubt as to the claimant’s right and title pay­ment shall be only to the person producing legal authority.

40.  (a) Every disbursing authority who pays pension shall report promptly to the Director of Local Fund Audit the Death of any pensioner whose pension he was paying.
(b) Each Secretary, Zilla Grandhalaya Samstha shall sent to the Director of Local Fund Audit annually on the 5th January alist of all retired employees who were drawing their pensions in his district and whose deaths have come to his notice during the preceding year.
The list shall give the following information:

2.    Service or, Appointment
S.   Date of death
41.General Instruction:   The disbursed halves of the pension payment orders should be filed in a serial order in separate files one for each class of
pensions. The disbursing authority should keep the files locked up and should keep the key always in his personal custody and see that no one has any access to the files except under his authority and supervision and on his responsibility.

Register of Pension Payment Order:
42.    (a) Service pensions paid at Zilla Grandhalaya Samsthas: The Secretary, Zilla Grandhalaya Samstha should   keep a register  in   Form  prescribed in Annexure-IV of the pension payment orders issued in his district.  This register will serve as an index to the files of pension payment orders referred to in the instructions above. Whenever a new order is received the Secretary, Zilla Gran­dhalaya Samstha should see that it is correctly entered in this register with a red ink line ruled across the page below the entry, and should write his  initials against the entry in the column headed 'Name of pensioner'. The column headed 'remarks' should be left blank so long as the pension payment order is in force, when both halves of the order are returned to the Director of Local Fund Audit on account of the pensioner's death or are sent out of the office as a result of an
application for transfer of payment out of the district, the order  should be  re­moved permanently from the register and the file, the Secretary,  Zilla Grandha­laya Samstha should have the date and reason for sending away both  halves of the order entered at once in the column headed 'Remarks' and initial the entry.
(b)    On receipt of an intimation about the death of a pensioner,   prompt action should be taken to record the fact in the register referred to in clause (a) above and on the disburser's half of the pension payment order.
In the case of pensioners whose pensions are paid by money order under instruction 28 the necessary note should be made on both halves of the pension payment order.
(c)    Service pension paid at Zilla Grandhalaya Samsthas when a pension is to be paid at a Zilla Grandhalaya Samstha the Secretary, Zilla Grandhalaya Sam­stha should enter the particulars of the pension payment order in  the  register referred to in subsidiary instruction (a) above in the manner described  in that subsidiary instruction. A note should be made in the column headed 'Remarks' showing the name of the Zilla Grandhalaya Samstha at which the pension is payable and the date of the pensioner's birth. The Secretary, Zilla Grandhalaya Samstha should then send and both the halves to the Director of Local Fund Audit who should after recording the necessary entries in his register of pension payment orders (Form in Annexure IV) retain the disbursers half and deliver the pensioner's half to the pensioner The registers should be mentioned in the manner prescribed.
43.    The Director of Local Fund Audit should by the 15th  November, of each year make out lists of pensioners paid from each Zilla Grandhalaya Sams­tha under this jurisdiction whose age, according to the records maintained  in his office, is over seventy years. He should send each list to the Zilla Grandha­laya Samstha concerned in order that the continued existence of each such pen­sioner may be tested by special enquiry.  The disbursing authority should see that this special enquiry is carefully made should report the result to the Director of Local Fund Audit without under delay. When the continued existence of a purdah lady has to be verified under this instruction the verifying authority should see that she is actually recognised by some respectable persons living in her town or village with whom he (the verifying authority) is personally acquainted.

44. Gratuities:- (a) The Secretary, Zilla Grandhalaya Samstha shall not pay any gratuity except on an authority received from the Director of Local Fund Audit to whom the sanction is communicated by the sanctioning authority. The Secretary, Zilla Grandhalaya Samstha, shall require the payees to produce the copy of the order by which the sanction to the gratuity was communicated to him, and shall record the fact of payment on the copy of the order so produced.

  1. A gratuity is payable only to and upon the receipt of the person legally entitled to receive it and not to or upon the receipt of, the head of the office or department in which that person formerly served.

  2. If a gratuity remains under own for more than three months the payment order shall be returned to the Director of Local  Fund Audit mentioning the cause if known, of the non-appearance of the person entitled to the gratuity.

NOTE: (1) No pension shall be liable to seizure, attachment or sequestration by process of any court in India at the instance of a creditor for any demand against the pensioner (Section II, Act No. XXIII of 1871.)
NOTE: (2) Payment under this order is to be made only to pensioner in person with the following exceptions:-

  1. To persons specially exempted.

  2. To females unaccustomed to appear in public and to persons unable to appear on account of illness or bodily infirmity.    Payment in both classes (a) and (b) is made on production of life certificate signed by a responsible officer of Government or other well known and trustworthy person (Article 945, C. S. R.)

  4. In all cases referred to in clauses (a) (b) and (c), the Disbursing officer must at least once a year, require proof, independent of that furnished by the Life Certificate of the continued existence of the pensioner (Article 947 (a), (C. S. R.)

NOTE: (3) On the decease of the pensioner, this order should be immedia­tely returned by his family to the Secretary, Zilla Grandhalaya Samstha with a report of the date of his decease.




ANNEXURE I
Instructions for the payment of pension to Leper pensioners through the Agency of Executive Authority of a Gram Panchayat:
On production of the Life Certificate by a leper pensioner and if he has intimated his desire to be paid in his village through the Executive authority of a Gram Panchayat where the leper pensioner has to be paid should a pension bill separately for each pensioner. The Bill together with the amount of the pension and a form of certificate of payment by the Executive Authority referred to in the next paragraph should be handed over to the executive authority where the pen­sioner resides, if the Executive Authority happens to come in person to cash the bill.
2. A register of payment of pensions to leper pensioners through the Executive authority of Gram Panchayats should be mentioned in the paying Zilla Grandhalaya Samstha in Form appended. Acknowledgements for the money paid and the bill handed over to the executive authority should be obtained in the column provide in the register for the purpose. The Executive Authority should, on receipt of the money, pay it promptly to the pensioner in the presence of two responsible villagers and sign a certificate of payment of the pen­sion forms on the bill or separately and get it attested by the same respectable witnesses : -

The signature or the thumb impression of the pensioner should never be taken for the payment.
After the disbursement of the amount, the Executive authority should return the pension bill with certificate referred to above to the Zilla Grandhalaya Samstha which issued it, on the next occasion, when Executive Authority of Gram Panchayats happens to go to the Zilla Parishads. The payment should however be brought to account in relevant monthly accounts of the Zilla Grandhalaya Samsthas concerned. Accordingly, when there is no likelihood of the return of the voucher with the certificate of payment to the Zilla Grandhalaya Samstha in time through an Executive Authority it should be sent to the Zilla Grandhalaya Samstha.

NOTE: (3) On the decease of the pensioner, this order should be immedia?tely returned by his family to the Secretary, Zilla Grandhalaya Samstha with a report of the date of his decease. 138 142 ANNEXURE I Instructions for the payment of pension to Leper pensioners through the Agency of Executive Authority of a Gram Panchayat: On production of the Life Certificate by a leper pensioner and if he has intimated his desire to be paid in his village through the Executive authority of a Gram Panchayat where the leper pensioner has to be paid should a pension bill separately for each pensioner. The Bill together with the amount of the pension and a form of certificate of payment by the Executive Authority referred to in the next paragraph should be handed over to the executive authority where the pen?sioner resides, if the Executive Authority happens to come in person to cash the bill. 2. A register of payment of pensions to leper pensioners through the Executive authority of Gram Panchayats should be mentioned in the paying Zilla Grandhalaya Samstha in Form appended. Acknowledgements for the money paid and the bill handed over to the executive authority should be obtained in the column provide in the register for the purpose. The Executive Authority should, on receipt of the money, pay it promptly to the pensioner in the presence of two responsible villagers and sign a certificate of payment of the pen?sion forms on the bill or separately and get it attested by the same respectable witnesses : - I certify that I have today paid in person to the sum of Rs . (in words) being his pension for the month(s) of Place : (SIGNED) Date : Signature of Executive Authority Paid in our presence:- 1. 2. (Signature of the witnesses) The signature or the thumb impression of the pensioner should never be taken for the payment. After the disbursement of the amount, the Executive authority should return the pension bill with certificate referred to above to the Zilla Grandhalaya Samstha which issued it, on the next occasion, when Executive Authority of Gram Panchayats happens to go to the Zilla Parishads. The payment should however be brought to account in relevant monthly accounts of the Zilla Grandhalaya Samsthas concerned. Accordingly, when there is no likelihood of the return of the voucher with the certificate of payment to the Zilla Grandhalaya Samstha in time through an Executive Authority it should be sent to the Zilla Grandhalaya Samstha.

3 When the pension bill is received back after disbursement, the Secreta­ry, Zilla Grandhalaya Samstha should record the fact of payment in both halves of the pension order under his initials. Necessary entries should also made in the register of payments of pensions.

  1. The amount handed over to the Executive Authority etc., for disburse­ments should be debited to "Suspense Payments" and that suspense item should be cleared on receipt of the pension voucher with the certificate of payment.

  2. The ordinary procedure for the payment of pensions should be followed in all other respects.

SCHEDULE-II
Rules relating to the Andhra Pradesh Zilla Grandhalaya Samstha Pension-cum-Gratuity Fund to be constituted in each Zilla Grandhalaya Samstha:

  1. These rules may be called the Andhra Pradesh Zilla Grandhalaya Samstha Pension-cum Gratuity Fund Rules, 1978.

  2. These rules shall apply to all the Zilla Grandhalaya Samsthas.

  3. In these  rules unless the context otherwise requires:

(i) "Fund" means the Andhra Pradesh Zilla Grandhalaya Samstha Pension-cum-Gratuity fund established and maintained by Zilla Gran­dhalaya Samstha.
(ii)  "Secretary" means the Secretary, Zilla Grandhalaya Samstha concerned.
(ill) "Liberalised Pension Scheme" means the Andhra Pradesh Liberalised Pension Scheme sanctioned in G.O.Ms. No. 231 Finance, dated 11th June, 1962.
(iv) "Employee" means an employee of the Zilla Grandhalaya Samstha eligible for the Liberalised Pension Scheme.
(v) "Treasury" means Government treasury with which the Zilla Grandhalaya Samstha concerned, is transacting its financial business,
(vi)   "Government" means the Government of Andhra Pradesh.
(vii)   "Audit Officer" means the Director of Local Fund Audit.
4.    Every Zilla Grandhalaya Samstha shall establish and maintain a Pension-cum-Gratuity Fund called the Andhra Pradesh Zilla Grandhalaya Samstha Pension-cum-Gratuity Fund for the benefit of the employees of the Zilla Gran­dhalaya Samstha who are eligible for the Andhra Pradesh Liberalised Pension Scheme sanctioned In G. O. Ms. No. 231, Finance, dated 11th June, 1962. This fund shall form part of the Zilla Grandhalaya Samstha Fund as an earmarked fund.
The fund shall be formed out of and maintained by every Zilla Grandhalaya Samstha out of the grants released by the Government for this purpose.
5.    T he grants-in-aid to be sanctioned by Government for each year towards meeting the expenditure on pension in respect of each employee of Zilla Grandhalaya Samstha shall be claimed, by each Zilla Grandhalaya Samstha in advance. The expenditure on pensions incurred by Zilla Grandhalaya Samstha in excess of the grants sanctioned by Government in a year shall be clai­med by Zilla Grandhalaya Samstha by way of additional grants in the first quarter of the succeeding year.

  1. The Funds shall be administered by the Secretary, Zilla Grandhalaya Samstha.

  2. The Secretary, Zilla Grandhalaya Samstha shall maintain cash book, Nomination Register, a register of investments and pension payment audit regis­ter in the forms appended to these rules. He shall   also maintain such other Register as may be prescribed by Government.

  3. All charges incurred during the year for establishment created for the maintenance of fund shall be initially met from salary grant of each Zilla Grandhalaya Samstha.

  4. The Register referred to in rule 7   shall   be maintained in accordance with such instructions as will be issued by the   Director of Local   Fund Audit from time to time for carrying out the purposes of the Fund.

  5. Any doubts arising   in administering the fund shall be referred   to Government for clarification.

ORDER:
There has been a request for the provincialisation of services of the employees under Zilla Grandhalaya Samsthas. Government have Carefully examined all aspects of the question and have decided that the services of the employees of the Zilla Grandhalaya Samsthas cannot be provincialised. However, those employees shall be given the same benefits as employees of other local bodies.

  1. Government have also decided that a sum not exceeding Rs. 57  lakhs (Rupees fifty seven lakhs only) shall be sanctioned annually as grant-in-aid to the Zilla Grandhalaya Samsthas to enable them to meet their expenditure on
    establishment including the expenditure consequent on the benefits being given to the employees on the same basis as the employees of the local bodies as mentioned in the proceeding para and that such releases of grant-in-aid shall  be made without insisting on matching contribution by Zilla Grandhalaya Samsthas as at present.

  2. With a view to ensuring that the grants available to Zilla Grandhalaya Samsthas are utilised to the maximum extent possible for purchase of books and not for establishment, Government have decided that there shall be a ban on
    employment of permanent full time workers in future in   the Zilla Grandhalaya Samsthas particularly at the level of deposit libraries, and that these should be manned by part-time personnel.

4.    In order to augment the resources available the Zilla Grandhalaya Samsthas for provision of library services, Government have also decided that the rate of Library Cess shall be raised from 4 paise in a rupee as at present to 6 paise.

5. Government direct that the employees of the Zilla Grandhalaya Samsthas shall, be eligible to the following benefits on the lines of the employees of other local bodies:-

  1. Pension including Family pension.

  2. Gratuity.

  3. General Provident Fund.

  4. Loans and advances to the extend and subject to the conditions laid down in the rules issued through G. O. Ms. No. 821/Edn. dt. 7-7-75,

  5. Free Medical attendance for  employees  drawing  pay not exceeding Rs. 300/-

  6. Application of revised Leave Rules, 1933.

6. The Director of Public Libraries is requested to initiate action to amend Section 21(3) of the Andhra Pradesh Public Libraries Act, 1960 with reference to paragraph 2 above,

Payment of Advances & Arrears of Pay to   ZGS Employees.

Rules Governing the Payment of Advances to Officers and Servants of Zilla Grandhalaya Samsthas
[G. O. Ms. No. 821, Education (E), 7th July, 1975.]


In exercise of the powers conferred by Section 25 of the Andhra Pradesh Public Libraries Act, 1960 (Act VIII of 1960), the Governor of Andhra Pradesh hereby makes the following rules governing the payment of advances to the staff employed by the Zilla Grandhalaya Samsthas :-


RULES FOR PAYMENT OF ADVANCE
1 (a) No advances shall be granted by the Zilla Grandhalaya Samsthas to its officers or servants for any purpose except for the following, namely that of:
(i) Purchasing conveyances;
(ii) Journeys on Tour or transfer;
(iii) Purchasing mosquito nets, if the Officers or servants reside or work in areas included in the list of areas where there is a risk of malaria drawn by the Director of Medical Services;
(iv) Advances on the eve of important festivals. Provided that the Director may, in special cases, permit the grant of advances for purposes other than those specified above, subject to the availability of funds with the Zilla Grandhalaya Samstha after meeting all items of expenditure.


NOTE :- The festival advances shall be sanctioned at the following rates during the financial year Full, Time, Contingency staff, their salary, other members of the staff Rs. 250/-. It shall be recovered in ten installments.

  1. The rules issued by Government from time to time in regard to sanction of similar advances to Government servants shall be observed by the Zilla Grandhalaya Samstha subject to the condition that sufficient funds are available with the Zilla Grandhalaya Samstha after meeting all items of expenditure with­ out asking any additional grant from the Government in this behalf.

  2. The Chairman, Zilla Grandhalaya Samstha, in respect of the Secretary and the Secretary, Zilla Grandhalaya Samstha in respect of the other employees shall be the sanctioning authorities of the above advances. The Secretary, Zilla Grandhalaya Samstha shall be responsible for proper recovery of the advances sanctioned to the employees.

ADVANCES FOR PURCHASING CONVEYANCES


2. A Zilla Grandhalaya Samstha may at its discretion, grant an advance to any of its permanent officers or servants for the purchase of motor Cycle or bi­cycle, subject to the following conditions namely:-

 (i) The advance shall be granted only when the Zilla Grandhalaya Samstha considers that in the interest of the service of the Zilla Grandhalaya Samstha the officer or servant should use a motor Cycle or bicycle for the discharge of his official duties;
(ii) The Motor Cycle advance shall be sanctioned only to those officers or servants drawing a basic pay of Rs. 200 and above and the amount sanctioned shall be recovered in 50 equal installments.
(iii) If the amount of such advance is for the purchase of Motor Cycle, it shall not exceed Rs. 4,500 or fifteen months pay or the anticipated price of the Motor Cycle, whichever is less. If the amount of advance is for the purchase of a bicycle it shall not exceed four months pay of the employee or Rs. 350 or the estimated price of the bicycle, whichever is less;
NOTE: The Government in their order No. G. O. Ms. No. 213 dt. 16-8-1979 enhanced the advances to maximum of Rs 9,000/- provided the individual who draws the basic pay of Rs 350/- per month.
(iv) The principal of the advance shall be recovered in not more than the installments specified in rule 7, and alter the principal is completely recovered, the interest shall be recovered in two installments;
(v) If the actual price pair for the motor cycle or the bicycle is less than the advance taken, the balance shall forthwith be refunded to the Zilla Grandhalaya Samstha.
(vi) The advance for the purchase of conveyance shall not be granted under this rule to the employees paid f from contingencies.

  1. The Zilla Grandhalaya Samstha shall at the time of payment of the advance for the purchase of a motor cycle, obtain from   the officer or servant concerned, an agreement in the form prescribed in the first Schedule to this order.

  2. The officer or servant:-

(i) Execute at his expense Mortgage bond in the form prescribed in the second Schedule to pledge the motor cycle to the Zilla Grandhalaya Samstha security for the advance;
(ii)   Produce for audit, the accounts connected with transaction; and
(iii) Keep the Motor Cycle, duly insured. He shall be responsible for the payment of the insurance premium until the advance is fully repaid.
The Zilla Grandhalaya Samstha shall furnish intimation to the Insurance Company in the form prescribed in third Schedule

  1. The   Zilla Grandhalaya Samstha shall, when granting an advance for the purchase of a bicycle take sufficient security for the repayment of advance. Such security shall be exclusive of the bicycle purchased.

  2. The officer or servant who has been granted the advance for the purchase of a bicycle shall with in a month from the date of drawal of the advance purchase bicycle and produce to the Zilla Grandhalaya Samstha, the accounts connected with the transaction, failing which the amount of the advance shall be recovered in full from his pay.

  3. (i) Every advance made under rule 2 shall be repayable in equal monthly installments not exceeding fifty if the advance is for the purchase of a motor cycle for the purchase of a bicycle: Provided that if in any case, where the amount of advance divided by the number of installments involved a fraction of a rupee, the amount of each installment except the last shall be rounded off to the next higher whole rupee, the necessary, reduction being made in the amount of the last installment.
    (ii) The recovery of the installment of the advance shall be effected regularly from the monthly pay bill of the officer or servant concerned and shall be watched through the Register of advances recoverable, to be maintained in the Office of the Zilla Grandhalaya Samstha;
    (iii) Simple interest shall be charged on the advance at the rate fixed by the Government for their servants from time to time and shall be calculated on the balance outstanding on the last day of each month. The interest thus charged shall be recovered in one or more installments, each such installment being not appreciably greater than the installment by which the principal was recovered. The recovery of interest shall commence from the month following the month when the whole of the principal has been repaid;
    (iv) in case of death of the Officer or servant of the Zilla Grandhalaya Samstha or of termination of his service, the balance of the advance, if any, with interest thereon shall be recovered immediately in one lump sum.
    8.    (i)   Where an advance is made to an Officer or servant for journeys on tour, the amount of such advance shall not exceed the traveling allowance admissible under the rules and should also not exceed the amount likely to be required to meet the Officers or servants, personal traveling expenses for a month or for the probable duration of the tour, whichever is shorter.
    (ii) The advance shall be recovered in full from the traveling allowance bill relating to the journey in respect of which the advance is drawn;
    (iii) When the officer or servant has drawn an advance of this kind, he should not be granted a second advance of the same kind until the first one, has been fully adjusted. The adjustment of the advance shall be watched through the register of Tour advance maintained in the office of the Zilla Grandhalaya Samstha

9.  (i)   Advance may be made to an officer or servant under orders of transfer up to an amount not exceeding one month substantive pay plus the traveling allowance to which he may be entitled under the rules in consequence of the transfer;
(ii) Such advance shall be recorded in the Officers' or servants' last pay certificate;
(iii) The advance of pay shall be recovered from the pay of the Officer or servant in three equal monthly installments beginning with the month in which a full month's pay is drawn after the transfer.
The just two installments should be fixed in whole rupees and the remaining balance including any fraction of a rupee shall be recovered as the third installment;
(iv) The advance of traveling allowance shall be recovered in full on the submission of the officers’ or servants' traveling allowance bill;
(v) The adjustment of the above advance shall be watched through the Register of Advances recoverable.

ADVANCE FOR THE PURCHASE OF MOSQUITO NETS


10.  (i)   An advance made to an officer or servant for the purchase of mosquito nets shall be limited to the amount actually required for the purchase of mosquito nets for his use and for the use of the members of his family subject to a maximum of a month's pay of the officer or servant concerned including dearness allowance or Rs. 75 whichever is less;
(ii)   The advance shall be free of interest;
(iii)  The advance shall be repayable in equal monthly installments not exceeding twelve;
(iv)  The recovery of Installment of advance shall be made regularly from the monthly pay bill of the officer or servant and watched through the Register of Advances. In case of death of the Officer or servant or termination of his service, the balance of advance if any, shall be recovered in one lump sum.
FESTIVAL ADVANCE
11. (i)   A Zilla Grandhalaya Samstha may grant festival advance to its officers and servants including the workers paid from contingencies at the rate to Government servants of similar status;
(ii)   Casual employees shall not be eligible for the advance;

(iii) Before these advances are sanctioned to temporary staff, sureties, from permanent Officers or servants or any other form of security considered adequate by the Zilla Grandhalaya Samstha shall be obtained. The Zilla Grandhalaya Samstha may at its discretion dispense with those requirements in the case of temporary staff who have completed three years of continuous service and are likely to continue in service till the adjustment of the advance;
(iv) The advance shall be admissible on the eve of any festival mentioned in the list of holidays notified by the Government every year irrespective of the community to which the Applicant may belong and also irrespective of whether a general holiday or optional holiday has been declared for the festival in question;
(v) Only one advance shall be sanctioned to an individual in a financial year.
(vi) No further advance shall be granted until thearrears of the previous advances, if any, have been completely recovered.
(vii)  The advance is admissible only to that on duty or on earned leave on full pay at the time the advance is drawn;
 (viii) The advance shall be paid not earlier thon two weeks immediately preceding the festival;
(ix) The advance shall be recovered in not more than six equal monthly installments by deduction from the pay bill, the first installment being recovered from the pay following the month in which the advance was made.  The amount of each installment shall be rounded off to the nearest rupee, any balance being recovered in the last installment;
(x) The recoveries of the advance shall be watched through the Register of Festival Advances maintained in the office of the Zilla Grandhalaya Samstha.
12. (i) Whenever the advance is not completely recovered before the transfer of an employee from the Zilla Grandhalaya Samstha to another Zilla Grandhalaya Samstha the details of the dues should be shown in the last pay cer­tificate and sent to the office to which the employee is transferred;
(ii) On receipt of the last pay certificate, the Zilla Grandhalaya Samstha to which the employee is transferred should immediately reimburse the amounts of advances of pay, traveling allowance and other advances detailed in the last pay certificate in lump sum to the Office which originally paid the advances and take action to recover the balance of amounts due from the employee as detailed in the last pay certificate;
(iii) In the case of transfer of a Government servant to the service of the Zilla Grandhalaya Samstha on foreign service terms, the foreign employer should reimburse the amount of advance of pay and traveling   allowance in lump sum to Government on reversion from foreign service, the competent authority in Government will reimburse the amount of advance of pay in lump-sum to the foreign employer.

 (3) to execute a document hypothecating the said motor car/cycle to the

Zilla Grandhalaya Samstha the sum of Rs................................... ........ ...... aforesaid or the balance thereof remaining unpaid at the date motor car/cycle either by public auction or private contract and may put of the sale moneys retain the balance of the said advance then remaining unpaid and any interest due thereon calculated as aforesaid, and all costs, charges, expense and payments properly in­curred or made in maintaining, defending or realizing their rights hereunder and shall pay over the surplus, if any, to the Borrower, his executors, administrators or personal representatives, Provided further that the aforesaid power of taking possession or selling of the said Motor car/cycle shall not prejudice the right of Zilla Grandhalaya Samstha to sue the Borrower or his personal representatives for the said balance remaining due and interest or in the case of the motor car/cycle being sold the amount by which the net sale proceeds fall short of the amount owing and the Borrower hereby further agrees that so long as any moneys are remaining due and owing to the Zilla Grandhalaya Samstha, he the borrower, will insure and keep insured the said motor car/cycle ag­ainst loss or damage by fire, theft or accident with an insurance company to be approved by the Accountant General, Andhra Pradesh and will produce eviden­ce to the satisfaction of the Accountant General, Andhra Pradesh that the motor insurance company with whom the said motor car/cycle is insured have received notice that the Zilla Grandhalaya Samstha, are interested in the Policy and the Borrower hereby further agrees that he will not permit or suffer the said motor car/cycle to be destroyed or injured or to deteriorate in a greater degree than it would deteriorate by reasonable wear and tear thereof and further that in the event of any damage or accident happening to the said motor car/cycle the Borrower will forthwith have the same repaired and made good.

ORDER:
According to the orders issued In the Government orders cited, all Officers of the State Government including All India Service Officers working in the State and drawing a basic pay of Rs. 700/- p.m. and above are eligible for a Motor Car Advance of 25 times the basic pay subject to maximum of Rs. 33,000-00 or the actual price of the Motor car to be purchased whichever is less. Similarly, all Officers of the State Government who are drawing a basic pay of Rs. 350/- per month and up to Rs 1,500/- per month are eligible for Motor Cycle Advance of 15 times the basic pay subject to a maximum of Rs. 4,500/- or actual price of the Motor Cycle whichever Is less.

  1. It has been represented to Government that in view of the abnormal increase in the prices of the vehicles, the advances admissible under the existing rules is not adequate and that Government may revise the loan limits for both motor cars and motor cycles.

  2. Government after careful consideration hereby order as follows:

  1. All Officers of the State Government including All India Service Officers working in the State and drawing a basic pay of Rs. 700/- per month and above shall be eligible for a motor Car Advance of 25 times of basic pay subject to a maximum of Rs. 44,000/- or the actual price of the Motor Car to be purcha­sed whichever is the least.

  2. All Officers of the State Government who are drawing a basic pay of
    Rs. 350/- and up to Rs. 1,500/- per month shall be eligible for Motor Cycle Advance of 15 times of basic pay subject to a maximum of Rs. 9,000/- or actual price of the Motor Cycle whichever is the least.

  1. The above orders will come into force with effect from the date of issue of this order.

  2. Past cases already sanctioned will not be reopened.

  3. Necessary amendments will be issued separately to the Andhra Pradesh

    ORDER:
    In his letter first read above, Chairman, City Grandhalaya Samstha, Hyderabad suggested that as in the case of aided colleges and schools, salary gra­nts may be released to the Zilla Grandhalaya Samstha every month, and the Treasury Officers of the concerned District may adjust monthly sanctioned amount to the account of the Zilla Grandhalaya Samstha under intimation to the Director of Public Libraries who was consulted in the matter has reported that:

(i) The Director of Public Libraries may be permitted to sanction quarterly Salary grants to the Zilla Grandhalaya Samsthas from the budget provision placed at his disposal instead of the Government.
(ii) The present procedure of obtaining the counter signature of the Director of Public Libraries/Assistant Director of Public Libraries on the bills prepared by the Secretary, Zilla Grandhalaya Samstha may be dis­pensed with.
2.    The Government after careful consideration directs that;
(a)    The Director of Public Libraries shall sanction monthly Advance Salary grants to the Zilla Grandhalaya Samstha on the basis of the  actual  ex­penditure incurred on the staff (other than contingent staff) by the Zilla Grandhalaya Samsthas during the previous year,  as certified   by  Local Fund Audit Department, from the annual budget provision  subject to the following conditions:
(i) The Director of Public Libraries shall give a month wise programme for the release of grants; and furnish copies of the orders issued by him from time to time to the Government.
   (ii)    No excess grants or advance grants for the succeeding year shall be released to the Zilla Grandhalaya Samsthas under any circumstance.
(b)    The Director of Public Libraries shall submit to the Government, proposals for release of final grants after the audited figures for the year are received.
3.    The Government also accept the recommendation of Director of Public Libraries to dispense with the procedure of obtaining counter signature of the Director of Public Libraries/Assistant Director of Public Libraries on the bills prepared by the Secretary, Zilla Grandhalaya Samstha in respect of the advance salary grants sanctioned by the Director of Public Libraries.

ORDER:
The following notification will be published in the Andhra Pradesh Gazette:
NOTIFICATION
In exercise of the powers conferred by sub-section (l) and clause (e) of subsection (2) of section 25 of the Andhra Pradesh Public Libraries Act, 1960 (Andhra Pradesh Act VIII of 1960), the Governor of Andhra Pradesh hereby makes the following rules relating to procedure for payment of arrears of pay, allowances and increment to staff for Public Libraries maintained by Zilla Grandhalaya Samsthas.
1.    Any claim of a member of the Staff of Zilla Grandhalaya Samstha  for arrears of pay, allowance or increment of pay which have been allowed to remain in abeyance shall, before payment, be investigated by the Secretary of the Zilla Grandhalaya Samstha;
1.    With the sanction of the Zilla Grandhalaya Samstha, in case of claim relating to a period not exceeding six months; and

2.    With the sanction of the Director of Public Libraries, in the case of claim relating to a period exceeding six months.

2.          The payment of arrear claim ordered under clause (i) of rule, shall not exceed the amount found to be actually due under the claim in respect of a period of one year immediately preceding the date of detection of the under payment.   If, in any particular case, it is considered that for special reasons a large concession should be granted, the Secretary, Zilla Grandhalaya Samstha shall consult the Examiner of Local Fund Accounts, in the first instance, and then obtain, if the Examiner of Local Fund Accounts so advises, the sanction of the Director of Public Libraries, for payment of arrears for a period exceed­ing one year.
